Re: Second Proposed Health Maintenance Organization Regulations

Dear Mr. Howell:

This is in response to your inquiry to sent [sic] to Councilmember Jack Evans on August 6, 1999. I have reviewed your concern in reference to subsection 3513.3 of the Second Proposed Health Maintenance Organization Regulations. The Department agrees that the words "sexual orientation" should be included in subsection 3513.3. This subsection will be amended in accordance with the Council of the District of Columbia's intent in D.C. Code, Title 1, Chapter 25, Para. 2501 (1992 Repl.). Amended subsection 3513.3 of the HMO Regulations will read as follows:

"No HMO shall discriminate against any enrollee or applicant seeking enrollment for reasons other than that of the enrollee's or applicant's own merit. This includes, but is not limited to, discrimination by reason of race, color, religion, national origin, sex, age, marital status, personal appearance, sexual orientation, family responsibilities, matriculation, political affiliation, disability, source of income and place of residence or business, or because of the frequency of utilization of services by an enrollee. Further, nothing shall prohibit an HMO from setting rates or establishing a schedule of charges in accordance with relevant actuarial data."
